Gardeners Barnet Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Barnet provides gardening and related services to residential and commercial clients. By booking or using any of our services you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

Definitions

In these Terms and Conditions the following expressions have the meanings set out below.

Client means any individual, company, or organisation that requests or receives services from Gardeners Barnet.

Services means gardening, garden maintenance, hedge trimming, lawn care, planting, garden clearance, or any other services that Gardeners Barnet agrees to provide.

Agreement means the contract between Gardeners Barnet and the Client incorporating these Terms and Conditions and any written quotation or confirmation.

Work Location means the garden, outdoor area, or premises where the Services are to be carried out.

Booking Process

All bookings for Services are subject to acceptance by Gardeners Barnet. A booking may be requested by the Client via an online form, written correspondence, or other method made available by Gardeners Barnet from time to time.

Gardeners Barnet will normally provide a quotation for the requested Services based on the information supplied by the Client, which may include descriptions, measurements, photographs, or an on-site visit. Quotations are given in good faith but are not binding where the information provided by the Client is incomplete, inaccurate, or misleading.

A booking will be considered accepted and an Agreement formed only when Gardeners Barnet confirms the booking in writing or when Gardeners Barnet commences the Services, whichever occurs first. Gardeners Barnet reserves the right to refuse any booking at its discretion.

The Client is responsible for ensuring that all details in the booking confirmation, including the description of Services, date, time, and Work Location, are accurate. Any corrections or changes must be communicated to Gardeners Barnet as soon as possible and may result in an adjustment to the quotation or schedule.

Access and Client Responsibilities

The Client must ensure that Gardeners Barnet has safe and reasonable access to the Work Location on the agreed date and time. This includes providing access through gates, communal areas, or other controlled points as relevant. If access is not available at the agreed time, Gardeners Barnet may charge a call-out or waiting fee or treat the appointment as a late cancellation.

The Client must ensure that the Work Location is reasonably clear of obstacles and hazards and that pets, children, and other persons are kept clear of the working area for health and safety reasons.

The Client must inform Gardeners Barnet of any known issues at the Work Location, including underground services such as pipes, cables, or irrigation systems, and any other potential hazards. Gardeners Barnet will not be liable for damage arising from hazards that were not disclosed or that could not reasonably have been identified.

Scope of Services

The scope of Services will be as described in the quotation or booking confirmation. Any additional or varied work requested by the Client after the Agreement is formed may be subject to an additional charge and may require a revised quotation.

Gardeners Barnet will carry out the Services with reasonable skill and care and in accordance with applicable standards for garden maintenance and related work. However, gardening work is affected by factors outside our control, including weather, soil conditions, plant health, and pests, and Gardeners Barnet does not guarantee specific outcomes such as plant survival, growth rate, or lawn condition.

Gardeners Barnet reserves the right to decline to carry out any work that it considers unsafe, unlawful, inappropriate for the conditions, or beyond its professional competence or equipment capability.

Pricing and Payment Terms

Unless otherwise stated, quotations are given in pounds sterling and are exclusive of any applicable taxes or statutory charges. Any taxes or charges in force at the time of the Services will be added to the invoice where applicable.

Gardeners Barnet may charge on an hourly rate, per visit, per project, or on another agreed basis. Any minimum call-out or minimum charge will be notified to the Client before the booking is confirmed.

Payment is due in accordance with the terms stated on the quotation or invoice. In the absence of specific payment terms, payment is due immediately on completion of the Services for domestic Clients, and within 14 days of the invoice date for commercial Clients.

Gardeners Barnet may require a deposit or advance payment before commencing work, particularly for larger projects, new Clients, or where materials must be purchased in advance. Any required deposit will be set out before the booking is confirmed.

If payment is not received by the due date Gardeners Barnet may suspend further Services, charge interest on overdue amounts at the statutory rate or a reasonable commercial rate, and recover any reasonable costs incurred in collecting overdue payments.

Cancellations and Rescheduling

The Client may cancel or request to reschedule a booking by giving notice to Gardeners Barnet. Where possible, Gardeners Barnet requests at least 48 hours notice before the scheduled start time for standard appointments and at least 7 days notice for larger or project-based work.

If the Client cancels or reschedules with less than 24 hours notice, Gardeners Barnet may apply a late cancellation fee which may be up to the full value of the scheduled Services, particularly where our team has already been allocated, materials have been purchased, or travel arrangements have been made.

Gardeners Barnet reserves the right to cancel or reschedule a booking due to weather conditions, staff illness, access issues, or other circumstances beyond its reasonable control. Gardeners Barnet will seek to provide as much notice as practicable and will offer an alternative date and time. Gardeners Barnet will not be liable for any loss or inconvenience arising from such cancellation or rescheduling.

Weather and Site Conditions

Gardening work is affected by weather and site conditions. For safety and quality reasons, Gardeners Barnet may decide that it is not appropriate to carry out certain tasks in adverse conditions, such as heavy rain, strong winds, snow, ice, or extreme heat.

Where weather or site conditions prevent completion of all scheduled tasks, Gardeners Barnet may prioritise work that can be completed safely and may rearrange the remaining tasks for a later date. Any such changes will be communicated to the Client and may result in adjustments to timing and charges.

Materials, Plants, and Equipment

Unless otherwise agreed, the price quoted for Services that include materials or plants covers standard quality suitable for general gardening use. If the Client requests specific brands, species, sizes, or premium materials, these may be subject to additional charges.

Ownership of materials and plants supplied by Gardeners Barnet will pass to the Client only once full payment has been received. Risk in such materials and plants passes to the Client upon delivery or installation at the Work Location.

Gardeners Barnet will use its own equipment and tools unless different arrangements are agreed. The Client must not use or operate Gardeners Barnet equipment or tools unless explicitly authorised to do so in writing and under supervision, and Gardeners Barnet accepts no liability for injury or damage resulting from unauthorised use.

Waste Handling and Environmental Regulations

Gardeners Barnet will handle garden waste in accordance with applicable UK environmental and waste regulations. Unless otherwise stated in the quotation or booking confirmation, the Services may not include removal of garden waste from the Work Location.

Where waste removal is included or requested, Gardeners Barnet will transport and dispose of garden waste in line with relevant regulatory requirements. Any waste disposal charges will be clearly identified and may be based on volume, weight, type of waste, and distance to the disposal site.

The Client is responsible for informing Gardeners Barnet if any waste at the Work Location may be hazardous, contaminated, or subject to special handling requirements. Gardeners Barnet reserves the right to refuse to handle such waste or to charge additional fees to comply with regulatory or safety obligations.

Gardeners Barnet supports responsible gardening practices and may offer advice on composting, recycling, and sustainable planting. Any such advice is provided for general information only and the Client remains responsible for compliance with local and national regulations relating to waste and environmental protection.

Health and Safety

Gardeners Barnet is committed to operating in a safe manner and complying with applicable health and safety legislation. The Client agrees to co-operate with any reasonable health and safety instructions given by Gardeners Barnet staff on site.

The Client must inform Gardeners Barnet of any specific risks present at the Work Location, including uneven ground, water features, loose structures, or known allergies to plants or products. Gardeners Barnet may refuse to carry out or may adapt certain tasks where health and safety is at risk.

Liability and Insurance

Gardeners Barnet will exercise reasonable skill and care in providing the Services. If Gardeners Barnet is found to be at fault for loss or damage directly caused by its negligence, its liability will be limited to the direct cost of repair or replacement of the affected property, subject to any applicable insurance cover and policy limits.

Gardeners Barnet will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of enjoyment, or loss of use, arising out of or in connection with the Services, whether in contract, tort, or otherwise.

Gardeners Barnet will not be responsible for pre-existing defects, wear and tear, or structural issues at the Work Location, nor for damage resulting from such conditions. Gardeners Barnet will also not be liable for damage arising from instructions provided by the Client that Gardeners Barnet has advised against.

Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited under UK law.

Complaints and Defects

If the Client is dissatisfied with any aspect of the Services, they must notify Gardeners Barnet as soon as reasonably possible and in any event within 7 days of completion of the relevant work. Gardeners Barnet will investigate the concern and, where appropriate, may offer to rectify or repeat the Services or provide another reasonable solution.

Failure to raise a complaint within the stated period may affect Gardeners Barnet ability to investigate the issue and may limit any remedies that can be offered, except where the law provides otherwise.

Data Protection and Privacy

Gardeners Barnet will handle personal data provided by the Client in accordance with applicable UK data protection law. Personal data will be used for the purposes of managing bookings, delivering Services, issuing invoices, and maintaining records. Gardeners Barnet may also use contact details to provide information about related services, subject to any legal requirements regarding consent.

Gardeners Barnet will take reasonable steps to protect personal data from unauthorised access, loss, or misuse. The Client has certain rights regarding their personal data, which may include the right to access, correct, or request deletion of their information, subject to legal and regulatory obligations.

Force Majeure

Gardeners Barnet will not be liable for any delay or failure to perform its obligations under the Agreement where such delay or failure is due to events or circumstances beyond its reasonable control. These may include severe weather, natural disasters, pandemics, industrial disputes, transport disruptions, or actions of authorities.

In such circumstances, Gardeners Barnet may suspend the Services for the duration of the event or may offer to reschedule or adjust the work. If the event continues for a prolonged period, Gardeners Barnet or the Client may have the right to terminate the Agreement upon reasonable notice, without further liability, except for charges due for Services already provided.

Termination

Either party may terminate the Agreement immediately by written notice if the other party commits a serious breach of these Terms and Conditions and, where the breach is capable of remedy, fails to remedy it within a reasonable period after being notified.

Upon termination, the Client must pay for all Services provided up to the date of termination and for any materials or costs irrecoverably committed to the project. Any rights and obligations that are intended to continue after termination, including those relating to payment, liability, and governing law, will remain in force.

Changes to Terms and Conditions

Gardeners Barnet may update these Terms and Conditions from time to time to reflect changes in law, business practices, or service offerings. The updated version will apply to new bookings from the date it is made available. For existing Agreements, the version in force at the time of booking will normally apply unless both parties agree otherwise.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Gardeners Barnet.

By proceeding with a booking or allowing Gardeners Barnet to commence work at the Work Location, the Client confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
